Conditions
Cape Sensations and their servants and agents shall not be held responsible for and shall be exempt from all liability in respect of loss, damage, injury, accident, delay, or inconvenience to any person, or his luggage or other personal property, wherever the same shall occur and whether the same shall arise from or be occasioned by negligence of Cape Sensation, their servants or agents or other persons directly or indirectly in the employment or services of the company or otherwise under any circumstances whatsoever. CAPE SENSATIONS TOURS reserves the right to change any route and/or arrangement where deemed necessary. All prices are subject to change without prior notice.
Cape Sensations recommend that the following insurance covers are made prior to travel:
Full Trip Cancellation / Default
- Baggage / Loss or damage of personal effects
- Medical - major and accidental, including emergency evacuation
- Accidental death and disability
The cancellation policy will apply should clients fail to join or start their itinerary due to airline delays or missed connections. Please ensure clients have adequate travel insurance for this purpose
Cancellation by the Company
The company reserves the right to alter an itinerary after a departure if it is in the client’s interest to do so. The Company will not be held responsible for any compensation to the client if the Company have to cancel or in a way change the tour or cancel the tour due to force majeure, namely war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions or other external circumstance beyond the Company's control
Baggage
**All baggage and personal affects are at all times at the clients own risk and the Company cannot accept liability for any loss or damage to baggage or personal effects.
Information
The company reserves the right to change prices due to unforeseen increases or exchange rates fluctuations to which it maybe subjected. The Company also reserves the right to change any of the facilities or vehicles described in the brochure, without becoming liable for compensation or refund.
Insurance
We recommend the comprehensive Travel Insurance Policy with a 24 Hour – a – day telephones assistance. Please do not rely on credit card cover only. It is rarely sufficient for family needs when traveling overseas. If you are only taking credit card insurance, Please check with the bank concerned regarding the cover
Travel Documentation
It is the responsibility of the Client to be in possession of a valid passport, visa requirements, vaccinations and other medical certificates and all other travel documents and or payments where applicable, local payments in foreign currencies. The Company does not accept any responsibility in changes in regulations for visas or any particular requirements for visas. The Company cannot be held responsible for the failure of the Clients to obtain the necessary travel documents. Should the client be refused entry to any country due to incorrect or incomplete documentation, the Company is not liable for any cost of such delays or repatriation costs for the clients.
Transport
All tours are conducted in luxury air-conducted vehicles.
Group Size
A maximum of 4 persons (per 7-seater vehicle ensures a high quality service.)
Surcharges on Credit Car Payments
If the Company accepts payment by Credit Card from a Client or Booking Agent, a merchant fee surcharge of 3.5% applies
Refunds & Unused Services
No refunds will be made for no-shows or any unused services.
Jurisdiction
This booking and eventual contract between the client and CAPE SENSATIONS TOURS shall be deemed to be concluded in Cape Town, Republic of South Africa; and shall be interpreted according to the laws of the Republic of South Africa. In the event of any action hereunder, the Supreme Court of South Africa (Cape Town Local Division) shall have jurisdiction in regard thereto, not-with-standing that the amount of the claim may be within the jurisdiction of the Magistrate's Court.

CAPE SENSATIONS TOURS, their staff and / or agents will not be held responsible for, and shall be exempt from liability in respect of any loss, damage, injury, accident, delay or inconvenience to any person and / or his / her luggage and / or any personal property, whenever the same shall arise from, or be occasioned by the negligence of CAPE SENSATIONS TOURS, their staff and / or agents, or any other person directly or indirectly in the employment or service of CAPE SENSATIONS TOURS or otherwise under any circumstances whatsoever.
PLEASE NOTE: A new law has been passed stipulating that all visitors to South Africa are required to have a minimum of two blank pages in their passport to enable the entry visa to be issued. If there is insufficient space in the passport, entry will be denied and the person is likely to be detained pending return to their country of origin.
